Article 1: General provisions

CINEMORT EUROPA offers through the website Palmedocumentary.com its customers the opportunity to access digital products in its online shop.

These General Terms and Conditions apply to any order placed by a visitor to this e-commerce website. When placing an order via CINEMORT EUROPE’s online shop, the Customer expressly accepts these Terms and Conditions, thereby agreeing to their applicability to the exclusion of all other terms and conditions. Article 2: Price

All prices stated are expressed in EURO, always including VAT and all other duties or taxes to be borne by the Customer.

If delivery, reservation or administrative costs are charged, this will be stated separately.

The stated price refers exclusively to the articles as described verbatim. The accompanying photos are for decorative purposes and may contain elements not included in the price.

Article 3: Offers

Despite the fact that the online catalogue and the e-commerce website are compiled with the greatest possible care, it is still possible that the information offered is incomplete, contains material errors or is not up-to-date. Obvious mistakes or errors in the offer do not bind CINEMORT EUROPA. CINEMORT EUROPA is only bound by an obligation of means as to the accuracy and completeness of the information offered. CINEMORT EUROPA shall in no case be liable in case of manifest material errors, misprints or printing errors.

If the Customer has specific questions regarding, for example, availability, delivery time or delivery method, we request the Customer to contact us in advance via our e-mail address.

The offer can be amended or withdrawn by CINEMORT EUROPA at any time. CINEMORT EUROPA cannot be held liable for the unavailability of a product. If an offer has a limited period of validity or is made subject to conditions, this is expressly stated in the offer.

Article 4: Online purchases

The Customer finds the desired product in the web shop of Palmedocumentary.com. After placing the desired product in the shopping cart, the Customer is directed to a page where the order can be paid. After payment, an order summary is displayed with a link giving access to the digital product ordered.

The Customer has the choice between the following payment methods:
– via credit card
– by bank card
– via PayPal

CINEMORT EUROPA has the right to refuse an order following a serious default by the Customer regarding orders involving the Customer.

Article 5: Delivery and execution of the agreement

After payment, an order summary is displayed with a link giving access to the digital product ordered. The Customer gets a 7-day access to the digital product via Palmedocumentary.com unless noted otherwise.

Article 6: Retention of title
The digital product delivered is protected by copyright. It is not permitted to share, resell, rent out, copy or alter (access to) the digital product without the express written consent of CINEMORT EUROPA.

Article 7: Right of withdrawal

The provisions of this article apply only to Customers who purchase items online from CINEMORT EUROPA in their capacity as consumers.

The legal right of withdrawal expires from the moment the Customer gains access to the digital product ordered.

Article 8: Warranty

CINEMORT EUROPA’s digital products are subject to the warranty rules set out in EU Directive 2019/770. The rules are applicable in all European Member States and are transposed in Belgium in the Civil Code (art. 1701/1 and following).

Article 10: Privacy

The personal data communicated by the Customer may only be used for the following purposes: execution of the purchase contract concluded, processing the order, sending newsletters, advertising and/or marketing purposes.

The Customer has a legal right to inspect and possibly correct his personal data, provided that the Customer identifies himself with a valid identity document. If necessary, the Customer may request the correction of data that are allegedly incorrect, incomplete or irrelevant.

CINEMORT EUROPA treats Client data as confidential information and will not pass it on, rent it or sell it to third parties.

The Customer is solely responsible for keeping his login data confidential and the use of his password. The password is stored encrypted, CINEMORT EUROPA therefore has no access to it.

CINEMORT EUROPA keeps online (anonymous) visitor statistics to see which pages of the website are visited and to what extent.

Article 11: Use of cookies

During a visit to the site, ‘cookies’ may be placed on the hard disk of your computer. A cookie is a text file that is placed in the browser of your computer or mobile device by the server of a website when you consult a website. Cookies cannot be used to identify individuals, a cookie can only identify a machine.

The Customer can set the internet browser to not accept cookies, to alert you when a cookie is installed or to delete cookies from your hard drive afterwards.

When visiting our website for the first time, you will be asked to agree to our use of cookies.

Article 12: Invalidity – non-enforcement

If any provision of these Terms is declared invalid, illegal or null and void, this shall in no way affect the validity, legality and applicability of the other provisions.

The failure at any time by CINEMORT EUROPE to enforce any of the rights enumerated in these Terms, or to exercise any right thereof, shall never be deemed a waiver of such provision and shall never affect the validity of such rights.

Article 13: Modification of conditions

These Conditions are supplemented by other conditions explicitly referred to and the general terms and conditions of sale of CINEMORT EUROPA. In the event of contradiction, these Conditions shall prevail.

Article 14: Proof

The Customer accepts that electronic communications and backups may serve as evidence.

Article 15: Applicable law – Disputes

Belgian law shall apply, with the exception of the provisions of international private law on applicable law.
